01Agreement to Terms

These Terms and Conditions ("Terms") govern your access to and use of Load Curl's website, dashboard, API, and related services (collectively, the "Service") operated by Load Curl Technologies ("Load Curl," "we," "us," or "our").

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use Load Curl.

02Eligibility and Accounts

You must be at least 16 years old and able to form a binding contract to use Load Curl. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

03Acceptable Use

Load Curl is designed for authorized load testing of systems you own or have explicit permission to test. You may not use the Service for unlawful, abusive, or unauthorized activity.

• →Do not test endpoints without authorization from the system owner
• →Do not attempt to disrupt, attack, or probe third-party infrastructure
• →Do not reverse engineer, scrape, or resell the Service without consent
• →Do not upload malware or attempt to bypass security controls

04Subscriptions and Billing

Paid plans are billed according to the pricing shown at checkout or in your organization settings. Fees are non-refundable except where required by law or explicitly stated in your plan.

We may change pricing with reasonable notice. Continued use after a price change constitutes acceptance of the new rates.

05Intellectual Property

Load Curl retains all rights in the Service, including software, branding, documentation, and report formats. You retain ownership of your test configurations, target URLs, and test results.

You grant Load Curl a limited license to process your content solely to provide and improve the Service.

06Service Availability

We strive for high availability but do not guarantee uninterrupted access. Maintenance windows, third-party outages, and force majeure events may affect the Service.

Beta features may change or be discontinued without notice.

07Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

08Limitation of Liability

To the maximum extent permitted by law, Load Curl will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill arising from your use of the Service.

Our total liability for any claim related to the Service is limited to the amount you paid Load Curl in the twelve months before the claim arose.

09Termination

You may cancel your account at any time. We may suspend or terminate access if you violate these Terms, create security risk, or fail to pay applicable fees.

Upon termination, your right to use the Service ends. Provisions that by nature should survive termination will remain in effect.

10Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles. Disputes will be resolved in the courts located in Wilmington, Delaware, unless otherwise required by applicable law.

11Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-product notice. Continued use after changes take effect constitutes acceptance.
